HOW TO ENTER: THE AUNTIE ANNE’S, INC. “WHAT A DIFFERENCE A FAMILY MAKES: A NEW TWIST ON GIVING BACK GRANT PROGRAM” (THE “GRANT PROGRAM”) BEGINS ON FEBRUARY 2, 2008 AND ENDS ON APRIL 4, 2008 (THE “APPLICATION PERIOD”). Eligible entrants are entered upon Auntie Anne’s, Inc. (“Auntie Anne’s) receipt of a completed Family Nomination Application (available at www.atwistongivingback.com) and letter of reference from the community group, municipality, or organization which benefited from entrants’ charitable works in the community via the U.S. mail at Auntie Anne’s, Inc., What a Difference a Family Makes Grant Program, 160-A Route 41, Gap, PA 17527 or the electronic submission of a completed Family Nomination Application (at www.atwistongivingback.com), including letter of reference. All application materials must be postmarked or electronically submitted on or before April 4, 2008 to be eligible. Sponsor is not responsible for lost, late, or incomplete entries, for those who cannot access the Internet or cannot click-through for any period of time or for messages that are garbled or if entry information is not captured correctly, or for any technical, hardware, software, Internet, virus contamination, network, human error, electronic malfunctions, or any other problems occurring during shipping or uploading of attachments, and/or for delay, failure, or malfunction for any reason.
Entrants must follow all instructions to enter and win. Limit one (1) entry per family. Entries cannot be acknowledged or returned and become the property of Sponsor upon receipt. Incomplete entries and entries not complying with all rules are subject to disqualification. No correspondence regarding entries will be acknowledged or entered into with entrants. By entering, each entrant forfeits to Sponsor all rights to the contents of his/her entry and the concepts embodied therein.

ELIGIBILITY: Grant Program is open to families composed of legal residents of, and physically located within, the 50 United States and the District of Columbia. Void where prohibited by law. For the purposes of this Grant Program, each entering family must consist of at least two individuals who are related in some way (i.e., intergenerational/blood relationships, domestic partners, and/or legally-recognized family relationships). The related individuals do not need to live in the same household to be deemed a “family.” At the time of entry, at least one (1) member of the nominated family must be at least 18 years of age or older or the age of majority in his/her state of residence, whichever is older. All entries must be submitted by an individual who is at least 18 years of age or older or the age of majority in his/her state of residence.
Sponsor’s employees and its parent company, affiliates, subsidiaries, and advertising and promotion agencies involved with this contest, and their immediately families or individuals living in the same households of such persons are ineligible to enter or win. For purposes of this Grant Program, “immediate families” are defined as parents, step-parents, children, step-children, siblings, step-siblings, and spouses. Grant Program is subject to all applicable federal, state, local laws and regulations. By participating, entrants agree to be bound by these Official Rules and accept decisions of the Sponsor as final in all matters relating to this Grant Program.

JUDGING CRITERIA: All entries will be judged by a qualified panel of judges approved by the Sponsor on the basis of passionate dedication to giving back in entrants’ local communities. This is demonstrated by entrants’ level of involvement (amount of time spent and years of service), overall community impact, and initiative (process of seeking giving back opportunity). All judging of eligible entries will be under the supervision of a qualified panel of judges, whose decisions are final in all matters relating to this Grant Program. The highest scoring entrant will be declared the Grand Prize winner, subject to verification of eligibility. The next nineteen (19) highest scoring entrants will be declared Finalist grant winners, subject to verification of eligibility.

NOTIFICATION: Winners will be notified by phone and/or mail on or about May 2, 2008. The Winners will be obligated to sign and return (i) an Affidavit of Eligibility and Release of Liability and (ii) an Internal Revenue Service W-9 Form prior to receiving prize. Winner selection is under the supervision of Sponsor, whose decisions are final. Disqualification and the selection of an alternate winner may result from any of the following: (i) potential winner’s failure to respond to notification within ten (10) days after its mailing or phone call; (ii) the return of any notice, donation, or prize as undeliverable; (iii) potential winner’s failure to execute and return the Affidavit of Eligibility and Release of Liability and/or) an Internal Revenue Service W-9; (iv) potential winner’s failure to claim a prize within ten (10) days after it is sent; and (v) other non-compliance with Official Rules.

GRANTS: One (1) Grand Prize: $20,000 grant to be used to fund the winning family’s charitable work. Nineteen (19) Finalist Prizes: each Finalist to receive a grant of $2,000 to be used to fund their families’ charitable work. No substitutions allowed except, at Sponsor’s sole discretion and winner’s written request, winner’s prize may be paid directly to the winning family’s favorite 501(c)(3) organization or public school.
All grant funds dispersed by Sponsor must be used in furtherance of entrants’ charitable eff0rts. Upon dispersal, all grant funds must be used by the winning families to direct and/or perform those tasks essential to carry-out the families’ proposed charitable works. Failure to use the awarded grants to further entrants’ community service work may result in Sponsor’s action to recover such prizes.

CONDITIONS: Sponsor reserves the right to terminate, cancel, or modify the Grant Program or to disqualify any entrant or entering family if, in Sponsor’s sole judgment, it determines that the integrity or fairness of the Grant Program has been, or could be, compromised or that the Grant Program is not capable of running as planned or fairly, including infection by computer virus, bugs, tampering, unauthorized intervention (hacking), fraud, technical failures, force majeure or any other cause. Should this Grant Program be terminated during the Application Period, judging will take place in the manner detailed above from all entries received up to the point of termination.
All federal, state and local taxes are the sole responsibility of the winner. Winner will be sent an IRS Federal 1099-MISC tax form for the retail value of any grant at or above $600. Grant values are in U.S. currency. Sponsor is not liable for award of any prize to entrants who have violated these Official Rules, or committed fraud or deception in entering or participating in the Grant Program or claiming the grant.
By acceptance of a grant, winners consent to the use of their names, photographs, likenesses, pictures, portraits, voice, biographical information and/or any statements made by each winner regarding the Grant Program or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. Entrants grant to Sponsor and its assigns the right to publish, adapt, use, edit and/or modify its application and entry materials in any way and all media, without limitation, and without consideration or acknowledgement to the Family. By participating, entrants and winners agree to release and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with preparation for, or participation in, the Grant Program, or possession, acceptance and/or use or misuse of the prize or participation in any Grant Program-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor assumes no liability for damage caused to entrant’s or any other person or entity’s computer hardware, software, or communications network, regardless of cause.

ADDITIONAL TERMS: Sponsor, Sponsor’s Franchisees, Sponsor’s parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility with regard to: (i) entries that contain inaccurate information or do not comply with these rules; (ii) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (iv) any inability of the winner to accept the prize for any reason; (v) if a prize cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism or weather; or (vi) any damages or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of this promotion or otherwise violating these rules. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events outside its control compromise the integrity or viability of the promotion, Sponsor reserves the right to void the entries at issue, modify the promotion and/or terminate the relevant portion of the Grant Program.
By entering, entrants agree that they will consent to Sponsor’s use of their information in all public relations campaigns or media venues, and will complete all paperwork required to participate in such media opportunities. Entrants further agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Grant Program, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state, and local courts located in Pennsylvania.
